Cases on the custodial rights for the father may arise, and have to be agreed by the mother of the child, the father and the child. Upon finalizing the agreement, the father will have the custodial rights. If in situations wherein an agreement is difficult to arrange on custody rights, the father must file a case to the Thai Family Court in order to prove that he must be given custodial rights over the child. The judge will give an assessment and decide based on evidence provided. The judge will be the only person who is authorized to make the final decision for custodial rights of the father. The court will have the final say.
By observing legalities, it would avoid problems and issues in the future that will affect your visa in Thailand. Speak to a Thailand lawyer if you are not certain so you will be guided for the process.
